TERMS & CONDITIONS

LEGAL NOTICE – Please read these Terms carefully. They form a binding contract under Indian law between you (the “User”) and Tragify. By downloading, accessing, pairing, purchasing, or otherwise using the Tragify mobile application, website, cloud services, or any Tragify‑branded hardware (collectively, the “Services”), you acknowledge that you have read, understood, and accepted these Terms. If you do not agree, do not use the Services.
1. ELIGIBILITY
You must be at least 18 years old and legally competent to enter contracts under the Indian Contract Act 1872. If you act on behalf of an organisation, you confirm you have authority to bind that entity.
2. LICENSE & PERMITTED USES

Tragify grants you a personal, non‑exclusive, non‑transferable, revocable licence to install and run one copy of the app on each device you own or control.

You may pair Tragify trackers solely for lawful, personal use—e.g., locating your own belongings, pets, or dependants with their informed consent (or parental consent for minors).

Commercial resale, rental, reverse engineering, de‑compilation, or modification of any part of the Services is prohibited.
3. PROHIBITED CONDUCT
You agree not to:

Use a tracker to surveil, stalk, harass, spy on, or otherwise infringe the privacy of any person.

Attach a tracker to any person, vehicle, or property without the owner’s express permission.

Intercept, scrape, mine, or harvest any data from the app or cloud platform.

Circumvent, disable, or tamper with encryption, firmware locks, or anti‑stalking safety alerts.

Upload malware, attempt unauthorised access, probe, or test the vulnerability of our systems.

Violate any applicable laws or third‑party rights (data protection, intellectual‑property, telecom, export‑control).
Misuse may lead to immediate suspension, termination, data hand‑over to competent authorities, and civil or criminal liability.
4. ANTI‑STALKING DISCLAIMER
Tragify includes proximity alerts, audible chimes, and device‑discovery tools designed to deter covert tracking.
These features do not absolve users of liability for unlawful surveillance. Users are solely responsible for ensuring their use complies with:

The Indian Penal Code § 354‑D (stalking) and § 507 (criminal intimidation by anonymous communication).

The Information Technology Act 2000 and allied rules.

Any state‑specific “anti‑goonda,” women‑protection, or privacy statutes.
5. ACCOUNTS & SECURITY
You must keep login credentials confidential and restrict access to paired trackers. All activities under your account are deemed authorised by you. Notify Tragify immediately at contact@tragify.com if you suspect unauthorised use.
6. HARDWARE SAFETY & COMPLIANCE

Trackers contain BLE radios (2.400‑2.483 GHz) and CR‑type coin‑cell batteries.

Do not ingest, dismantle, or expose devices to extreme heat (> 60 °C) or water unless rated IP67.

Dispose of batteries responsibly; never incinerate.

Use of radio equipment is subject to the Indian Wireless Telegraphy Act 1933 and WPC licence‑exempt norms (current ETA: ER426738/24).
7. PAYMENTS, RETURNS & REFUNDS
Payment terms are governed by our Refund & Cancellation Policy (latest version available at tragify.com/policies/refund). Hardware returns must follow the RMA procedure and deadlines stated therein. Digital goods are largely non‑refundable (§ 5 of that policy).
8. INTELLECTUAL PROPERTY
All software, firmware, designs, trademarks (incl. “TRAGIFY,” logo), and content are the exclusive property of Tragify or its licensors, protected under the Copyright Act 1957 and Trade Marks Act 1999. No rights are granted except as expressly stated.
9. USER‑GENERATED DATA & PRIVACY
Location traces, device names, and account details are processed per our Privacy Policy (tragify.com/policies/privacy). You retain ownership of your personal data, while granting Tragify a worldwide, royalty‑free licence to store, process, and transmit it solely to provide the Services.
10. THIRD‑PARTY SERVICES
The app may integrate Google Play Services, Apple Find My, Firebase Cloud Messaging, or map providers. Such services are subject to their own terms; Tragify disclaims liability arising from their performance or availability.
11. DISCLAIMER OF WARRANTIES
The Services are provided “as‑is” and “as‑available”. To the maximum extent permitted by law, Tragify disclaims all express or implied warranties—including, but not limited to, merchantability, fitness for a particular purpose, uninterrupted availability, and non‑infringement.
12. LIMITATION OF LIABILITY
In no event will Tragify, its directors, employees, or affiliates be liable for indirect, incidental, special, consequential, or punitive damages (loss of data, profits, goodwill, etc.) arising out of or in connection with the Services—whether based on warranty, contract, tort (including negligence), or any other legal theory—even if advised of the possibility.
Our aggregate liability shall not exceed the total amount you paid to Tragify in the 12 months preceding the claim.
13. INDEMNITY
You agree to indemnify, defend, and hold harmless Tragify from any claim, demand, action, or damage—including reasonable legal fees—arising out of (a) your misuse of the Services, (b) your violation of these Terms, or (c) your infringement of third‑party rights or law.
14. TERMINATION
Tragify may suspend or terminate your account and access to Services at any time, with or without notice, for any violation of these Terms or if required by law. Upon termination, licenses end immediately; usage data may be retained as required for legal compliance.
15. EXPORT & SANCTIONS COMPLIANCE
You shall not use, export, or re‑export Tragify hardware or software in violation of Indian export‑control laws, U.S. and EU sanctions, or applicable import restrictions.
16. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of India. Courts of Bengaluru, Karnataka shall have exclusive jurisdiction. You and Tragify may, however, elect to resolve disputes through arbitration under the Arbitration & Conciliation Act 1996 in Bengaluru, with proceedings in English before a sole arbitrator appointed by mutual consent.
17. SEVERABILITY
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
18. CHANGES TO TERMS
Tragify may modify these Terms at any time. Material changes will be posted at tragify.com/policies/terms at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
